These Terms are a legal agreement between you and LOCAL GROWTH s.r.o. They govern your use of the Communities websites, applications, and related features, which we call the Service.
By creating an Account or using the Service, you agree to these Terms and our Community & Safety Standards. Our Privacy Policy explains how we handle personal data. Additional terms shown before you use a particular feature or buy a paid service also apply to that feature or purchase.
If you use the Service for an organisation, you confirm that you have authority to accept these Terms for that organisation. If you cannot accept these Terms, do not use the Service.
Account:
a registered profile used to access the Service.
Community:
a group or space created and administered through the Service.
Organiser:
a person or organisation that administers a Community or hosts an event.
Member:
a person who joins a Community or participates in an event.
Consumer:
a natural person acting outside their trade, business, craft, or profession under applicable law.
Accounts and eligibility
You must be at least 18 years old to create an Account or use the Service. The Service is not intended for children.
Provide accurate, current information and keep it updated. Do not impersonate another person or misrepresent your connection to an organisation.
Keep your login details confidential and tell us promptly if you believe someone has accessed your Account without permission.
Do not share an Account or help someone avoid a restriction or suspension.
Organisers, members and real-world events
The Service helps Organisers and Members find and communicate with each other. Organisers may set reasonable membership or event requirements, provided those requirements follow the law and our Community & Safety Standards.
Unless a listing or purchase screen expressly identifies Local Growth as the organiser or seller, Organisers act independently. They are not our employees, agents, or representatives, and Local Growth is not a party to arrangements between Organisers and Members.
Meeting people in person involves risks that an online service cannot eliminate. Check event details, use reasonable judgment, protect your personal information, and contact local emergency services if someone is in immediate danger.
Payments, subscriptions and refunds
Community subscriptions
Some features are free. Community Organisers may buy optional subscriptions that unlock additional Community features. Before purchase, we show the price, taxes where applicable, billing period, renewal terms, and available cancellation method.
A recurring subscription renews for the displayed billing period until it is cancelled. You may cancel future renewal through the billing-management feature. Unless the purchase terms say otherwise, cancellation takes effect at the end of the current paid period.
Stripe provides payment-processing services for purchases from Local Growth. Stripe's terms and privacy notice may also apply. Local Growth does not store your full payment-card details. Bank or currency-conversion fees charged by your provider remain your responsibility.
Event costs
An Organiser may advertise a fee or other cost for an event. Unless the purchase screen expressly identifies Local Growth as the seller, the transaction is between you and the Organiser. The Organiser sets the event's payment, cancellation, and refund terms, and you should review them before paying.
Refunds
Refunds for purchases from Local Growth follow the terms shown at purchase and your mandatory consumer rights. We do not guarantee or issue refunds for transactions made directly with an Organiser.
Consumer withdrawal rights
If you are a Consumer and buy a service from Local Growth at a distance, you generally have 14 days from the day the contract is concluded to withdraw without giving a reason. Mandatory rights in your country continue to apply.
If you ask us to begin providing a service during the withdrawal period and then withdraw, you may have to pay a proportionate amount for the service already provided.
For a service that has been fully performed, the withdrawal right may end after you expressly agree to early performance and acknowledge that the right will be lost once performance is complete.
For digital content not supplied on a tangible medium, the withdrawal right may be lost once supply begins only after your express prior consent and acknowledgement.
The withdrawal right may not apply to leisure services that an Organiser or seller commits to provide on a specific date or during a specific period, such as certain event tickets.
To exercise a withdrawal right against Local Growth, send a clear statement to info@communities.site identifying your Account, the service purchased, and the purchase date. You may write: ‘I hereby withdraw from my contract for [service], purchased on [date].’
Your content and intellectual property
You keep ownership of the content you submit to the Service. You are responsible for it and must have the rights and permissions needed to share it. Do not submit content that is unlawful or infringes another person's intellectual-property, privacy, or other rights.
You grant Local Growth a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display, and distribute your content only as needed to operate, secure, and provide the Service according to the visibility settings you choose. This licence allows us to use service providers that process content on our behalf.
The licence ends when your content is deleted from our systems, except for reasonable technical backups, records we must retain by law, and content that other people have independently shared or incorporated into permitted Community activity.
If you believe content on the Service infringes your rights, identify the content and explain the concern through our contact page.
Rules, safety and moderation
Our Community & Safety Standards explain the conduct and content we do not allow, how to report a concern, how we moderate content, and how to ask us to review a decision. Those Standards form part of these Terms.
Do not interfere with the Service, introduce malicious code, bypass security or access controls, or place an unreasonable load on our systems.
Do not scrape, harvest, or use automated means to access the Service without our permission, except where applicable law does not allow us to restrict that activity.
Do not reverse engineer the Service except to the limited extent that applicable law expressly permits it.
Do not collect or share another person's personal data unless you have a lawful reason and any required permission.
Communities is for adults aged 18 and over. We do not allow child sexual abuse and exploitation (CSAE) or child sexual abuse material (CSAM).
Use the report control on Community content to report a child-safety concern. For anything that cannot be reported in the app, email safety@communities.site. Do not send or forward suspected CSAM; tell us where it can be found.
We may investigate suspected violations and take proportionate action. Depending on the circumstances, this can include limiting the visibility of content, removing content, restricting features, suspending an Account, or permanently disabling an Account.
When deciding what action is appropriate, we may consider the nature and seriousness of the conduct, context, potential harm, previous violations, and legal obligations. We may act immediately where necessary to protect people, the Service, or evidence.
Where required by law, we explain a restriction or removal and provide a way to ask for review. Our Community & Safety Standards explain the reporting and review routes available to everyone.
Do not evade an Account restriction or knowingly submit false or abusive reports.
The Service and third parties
We work to keep the Service available and secure, but we do not promise that it will always be uninterrupted or error-free. We may change, suspend, or discontinue features for operational, security, legal, or product reasons. We will give reasonable notice of material changes where feasible.
The Service may link to or integrate with third-party services. We do not control those services, and their own terms and privacy notices govern your use of them.
Responsibility and liability
Local Growth is responsible for loss caused by our breach of these Terms to the extent required by applicable law. We are not responsible for the independent acts, content, promises, events, or transactions of Organisers, Members, or other third parties, except where a loss was caused by our own breach.
To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when you accepted these Terms, for business losses suffered by a Consumer, or for delay or failure caused by circumstances reasonably beyond our control.
Nothing in these Terms excludes or limits mandatory consumer rights or any liability that cannot lawfully be excluded or limited.
Ending use of the Service
You may stop using the Service and close your Account at any time. Closing an Account does not automatically cancel a transaction made directly with an Organiser, and you should also cancel any recurring subscription you no longer want.
We may suspend or end access if you materially or repeatedly breach these Terms, if necessary to protect people or the Service, or if required by law. We give notice and reasons where feasible and legally required. Provisions that by their nature need to continue after termination remain effective, including provisions about content already shared, liability, and disputes.
Governing law and consumer disputes
These Terms are governed by the laws of the Czech Republic. If you are a Consumer, this choice does not remove mandatory protections you have under the law of your country of residence.
Please contact us first so we can try to resolve a concern. Consumers may also seek out-of-court dispute resolution through the Czech Trade Inspection Authority.
Nothing in these Terms prevents either party from using a court or another remedy available under applicable law.
Changes to these Terms
We may update these Terms as the Service or the law changes. If a material change affects your rights, we will give advance notice where required and explain when it takes effect. If you do not agree, you may stop using the Service and close your Account before the change takes effect.
Other legal terms
If a provision is invalid or unenforceable, the remaining provisions remain in effect.
Our failure to enforce a provision immediately does not waive our right to enforce it later.
You may not transfer your rights or obligations under these Terms without our prior consent. We may transfer ours as part of a merger, reorganisation, financing, or sale of the relevant business, subject to applicable law.
These Terms, the Community & Safety Standards, and any applicable feature or purchase terms form the agreement between you and Local Growth concerning the Service.
If these Terms are available in more than one language, the English version controls in the event of a conflict, without affecting mandatory protections under applicable law.
